PFAS Chemical Action Plan Advisory Committee

The advisory committee helps the Departments of Ecology and Health develop a Chemical Action Plan (CAP) for Per- and Poly-Fluorinated Alkyl Substances (PFAS).

PFAS CAP Comments and Timeline

Ecology and Health ask interested parties to review the preliminary CAP recommendations and provide feedback by July 1. We will accept comments on the updated chapters, but be unable to provide responses to comments until after the public comment period. All interested parties are welcome to submit comments online (due July 1).

   July 1, 2019: comments due on the preliminary CAP recommendations (submit online).
   Summer 2019: publish the Draft PFAS CAP (tenatively end of August).
       Hold a 60-day public comment period - with public meetings (Summer/Fall 2019).
   Fall 2019: finalize PFAS CAP.
       Hold an Advisory Committee meeting to review comments on the Draft CAP (late Fall 2019).
       Publish the Final PFAS CAP (early 2020).

PFAS in Food Packaging Alternatives Assessment

Background: In 2018, Washington State passed a law to prohibit all PFAS in plant fiber-based food packaging. The PFAS ban takes effect following the identification of safer alternative products as described in the Toxics in Packaging law (RCW 70.95G). The alternatives assessment (AA) must consider chemical hazard, performance, cost and availability, and exposure. Following the product evaluations, Ecology will submit their findings for external peer review and publish the results in the Washington State Register.

October 7, 2019 Update:

The PFAS AA will utilize four modules from the Interstate Chemicals Clearinghouse AA Guide: Hazard, Exposure, Performance, and Cost and Availability. Ecology will use decision rules for each of these assessment modules to help determine whether alternatives are safer as defined by the law (RCW 70.95G).

The decision rules regarding hazard will depend on a variety of hazard properties called endpoints. These are largely based on the toxic effects of chemicals and materials used in food packaging products. Manufacturers and suppliers will be asked to provide hazard data for use in Ecology’s assessment. A draft of the Hazard Assessment Methodology and an associated Hazard Assessment Overview document are available for review by interested parties.

Similar draft documents for the Exposure Assessment Methodology will be released in the coming weeks. Interested parties will have an opportunity to provide feedback on these methodologies in a forum to be announced later.

September 24, 2019 Update:

New PFAS in Food Packaging AA Website: To improve interested party communication, Ecology is developing a website dedicated solely to the PFAS in Food Packaging AA that will be separate from the current PFAS CAP. Interested parties will be alerted when this website is available.

Product/Sector Scope Survey: A Product Scoping Call was conducted on September 11, 2019 to hear additional feedback from respondents to the product scoping survey. Invitees to the call included survey respondents and others who requested an invitation. A summary of the product scoping survey results and a tentative scoping strategy were presented. The tentative scoping strategy limits the scope of the assessment to paper wraps and liners. We are also considering adding bags and sleeves to this scope. A tentative list of potential alternatives was also proposed. Under the RCW 70.95G, Ecology must continue reviewing potential alternatives if safer alternatives are not identified “for some or all categories of food packaging applications.” Paper wraps and liners would serve as a first phase of this work. Other applications such as containers, serviceware, pet food bags, etc., will be prioritized for further consideration.

SRC is seeking comments from all interested parties on the tentative scoping strategy. Please forward comments to Jenn Rhoades (rhoades@srcinc.com) by October 11, 2019. It is our goal to have a finalized list of candidate alternatives by mid-October.

Hazard and Exposure Modules: Hazard and Exposure Methodology and decision rules related to the hazard and exposure modules are under development and will be distributed to interested parties (Hazard by the end of September, Exposure in the coming weeks). These documents should help address interested party’s questions about the data needs and how manufacturer/supplier information will be incorporated into this assessment. We recognize that the alternatives assessment approach is new to many folks. The Interstate Chemicals Clearinghouse (IC2) Alternatives Assessment Guide v1.1 will serve as basis for our approach. Upcoming Topics: We are planning the following topics for discussion with interested parties over the next few months. At high-level this will include:

Previous Updates

August 23, 2019 update: Product/Sector Scope Survey: Thank you to all who responded to the Product Scoping Survey! There were a total of 22 responses to the survey, which we are currently reviewing. Results of this survey will help inform the selection of candidate alternatives, as well as other portions of this assessment. The Scoping Survey is now closed, and the link has been disabled. Most respondents indicated that they were interested in participating in a group call to further discuss aspects of product scoping.

Product/Sector Group Call: A Product/Sector Group Call has been scheduled for September 11 at 2pm EST/11am PST. Invitations and agenda will be sent out shortly. The call is directed toward scoping survey respondents to further clarify the survey responses. If you did not participate in the scoping survey but would like to join the call, please contact Jenn Rhoades (rhoades@srcinc.com) to be added to the group call list.

Manufacturer CBI Submission: As a reminder, manufacturers can now submit information on coatings, chemical treatments, or other approaches to achieving oil and grease resistance in food packaging. Information on chemical identities, quantities used, and associated hazard, exposure or performance data are all relevant to Ecology’s safer alternatives determination. In cases where product information is considered as trade secret or CBI, manufacturers can request that their information be granted confidential treatment under RCW 43.21A.160. Manufacturers may request the assurance of confidential treatment prior to providing the actual information to Ecology. Additional details on the CBI submission process and a suggested request template are provided in the documents section of this webpage.

July 25, 2019 update:  Product/Sector Scope Survey: We are seeking information and data from interested parties to guide Ecology’s selection of food packaging products addressed by the alternatives assessment. The goal is to identify a manageable and meaningful product scope that allows us to prepare a scientifically justifiable assessment that both meets the requirements of the law and stays within the budget allocated by the Legislature. This survey closed 7/31/2019. PFAS “Base-case” Update: Ecology’s alternatives assessment methodology is based on the Interstate Chemicals Clearinghouse Alternatives Assessment Guide. The guidance includes a process to compare an existing chemical of concern with potentially safer alternative solutions. The base-case substance is food contact notification (FCN) 604 (599). This FCN covers Chemical Abstracts Service Registry Numbers (CASRN) 863408-20-2 and 1225273-44-8. Further information on these substances can be viewed at the US FDA. Peer Review Process: Ecology is in discussions with the Washington State Academy of Sciences (Academy) to manage and perform the peer review of Ecology’s food packaging work as required by RCW 70.95G. The Academy is a “nonprofit entity independent of government” formed to provide scientific analysis and recommendations on technical questions for state government (RCW 70.220). Project Timeline Extended: Due to project delays, Ecology has elected to extend the performance period for the SRC contract with Ecology to April 2020. Ecology’s final report preparation, internal reviews and external peer review work are expected to be complete by the Fall of 2020.

February 13, 2019 update: Following a competitive bid process, Ecology selected SRC, Inc. (SRC) as the contractor to support the development of the PFAS in Food Packaging AA. An updated Statement of Work, Deliverables, and Timeline are available that reflect the January 28, 2019 start date. SRC and Ecology are seeking input from interested parties on products in relevant food packaging applications, primarily packaging where oil and grease resistance are provided by PFAS or PFAS-free alternative technologies. Interested party contacts will begin February 22, 2019 and will continue throughout the project work.

January 7, 2019 update: Links to the Ecology PFAS AA Statement of Work, Deliverables, Timeline, Budget, and RFP background documents (these documents have been replaced by updated documents; see the February 13, 2019 update). These documents were provided to the list of approved contractors eligible to conduct work to support Ecology's PFAS AA. Ecology and Department of Health will evaluate and score the bids received, select the successful bidder, and get the project underway.

November 6, 2018 update: Comments on the Draft PFAS AA Project Summary are available online (comment period ended December 4, 2018).
